Basically, my new home has tear in bathroom floor about an inch long right in front of the shower. I included the tear in all written reports during the buying and inspection of the home.
Clayton Homes in Seguin Texas sent someone out to fix it twice, first with a glue and last time with an adhesive glue in a spray can. Neither fix worked. They now refuse to do anything including returning calls or letters.
So, should I try to fix it myself? Or file a complaint? Am I worried over nothing? Thanks for any advice.

First of all, it is important that you know that this a violation of the HUD code sec 3280.305(g)(2)(iv)(A).
It says the vinyl floor covering in wet areas must be "a continuous membrane with any seams or patches seam bonded or welded to preserve the continuity of the floor covering"

Yes - I would follow Eugene's advice. This is a very bad place for such a tear.
In fact, I would strongly consider getting a flooring contractor out to fix it professionally. It might cost you $100 - $200, but that is a pittance compared to what it would cost to repair water damage to your subfloor.
You can always try to recover your $$ later from the dealer. Just take pictures, document everything with notes, get two estimates and keep the receipts. You can file in small claims court.

OK, so the manufacturer refused to repair but the retailer has agreed to and is sending his team out on Tuesday with the vinyl.
My questions:
1. The vinyl flooring was obviously laid before the spa tub, toilette and shower were put in. Should all of these be removed to lay the floor? Or is it oK for them to just replace the part you can see and seal it down?
2. What should I be looking for as they repair this? Any hints as to what is a good job vs bad job?
3. Finally, and thank you for any help, should I just take the roll of flooring and get my own contractor in?
