Arbitration agreement?

Post by Kelly Smart » Wed Mar 30, 2005 2:10 pm

We had a service rep. look at our home today, when discussing our options for solving the problems we are having with the dealer and getting the necessary repairs done, he made reference to some paper we were supposed to have signed when we bought the home. I think he called it an arbitration agreenemt but I am not sure. What is he talking about? I showed him the bill of sale we signed which has an extra sheet from the dealer but he said that was not it and usually this paper goes to the factory.
Thanks
Kelly

Arbitration agreements usually say that you must use arbitration for all disputes, and do so until all abritration steps have been taken BEFORE you can seek any other legal remedy. You are entitiled to a copy of this signed agreement (as you are most documents related to your home).

Arbitration is just a way companies who would get sued a lot protect their "interests"In other words you would have a hard time suing them for repairs or neglect of due service. You would have to go into arbitration to reach a solution which usually means they hold the upper hand. If you signed this you would have a copy.

Sounds like you have a Cacvalier product..trhe factory requires the dealer to get you to sign this form and send it to them...Ask the factory for a copy...Arbitration is a legal process that is similar to small claims court...Arbitrators rulings hold the force of a court order...Long before you get to this point you should have filed a complaint with your states SSA.....Acouple web resources can be found here...

Arbitration agreements are also included with many extended warranties.
