Community Guidelines

Chrissy,

Your publications recommend the use of "Community Guidelines" rather than the older "Rules and Regualtions".

When we updated our documents recently, and had our attorney review them. He opined that this change of terminology was not advisable. He said that the use of the term 'guideline' implied something that was not mandatory, and would be understood by the layman as a recommendation. The use of the terms 'rules and regulation,' harsh though it sounds, implies mandatory adherence.

Has this type of comment come up before?

From time to time, an attorney has said that they feel the courts and/or the residents may not gain the proper level of respect for adherence to the terms of the document simply because of the name used. In those cases, most people then use an "opening paragraph," which I will provide to you free of charge. Please send me your mailing address, then have your attorney review it for applicability.

I have your Guidelines for Living manual and have used it to develop our R & R for our Community.

I just read this message and think I should add something about the Guidelines as being Rules & Regs. I didn't see anything in the manual about the paragraph you talk about. Is it in there? If not, can you please send me the wording so I can add it to my Introduction page?

You've never sent me anything via this Forum so don't know if you have my address somewhere. Let me know and I'll send it to you.

I also just read an article you wrote about annual inspections. Could you please send me the inspection form you mentioned?
