buying foreclosure on property? real property?

We are buying a foreclosure(doublewide on acreage, with foundation). the paperwork says the lot with all "realproperty, buildings and improvements". the title insurance only covers the property, not the mobile(according to them). One lawyer (here in NY) says this covers us HOWEVER the other lawyer says it doesn't and that we need a title or bill of sale in lieu of title! Now who do I believe? I don't want to end up owning the property and not the trailer or not being able to sell it if I decide to upgrade!

Title insurance covering the home and the property IS available to you..If it were not a mortgage company would not mortgage the property..

We have seen this lately in our area...Some attorney's are very conservative in their title oppinions...When this mortgage was made...the title was somewhere..most often it is retired through the state...sometimes they file the title with a lien..The original lender should be able to help you with this and tell you where it went..

The seller of the property should have no problem producing a bill of sale..All they would be doing is assuring the attorney that they own the home and have the legal right to sell it..

In New York a manufactured home is only real property for tax matters. Although the home can be listed as attached to the land on the deed.
