Post by Long » Fri Feb 10, 2006 12:30 pm

Last three month I came to dealer and buy a new manufactured home. I gave him $7000 to deposit and open escrow. This dealer abanded his bussiness. I apply to HCD recovery fund. Now they ask me to open a civil judment, no lawyer want to help me. I don't know how can I get that money back from HCD. Police can't find the owner of that dealer.

I am sure there is an attorney who will help you file for the judgement...Often small claims court will handle this size amount..here you can easily file yourself...An attorney will help fill out the proper paperwork to file in the next court up if that is necessary for a small fee...It would be much more costly ro have him represent you in person...but they will for a corresponding fee..You might try the legal aid society in your area...They sometimes help with reduced fees...If you can find others in the same boat..you could share the cost.....The recovery fund is probably the only place to get your money...

Sounds to me, not knowing any of the circumstances, that what they are telling you, is in order to help with the recovery, you must obtain a judgment, which will then be assigned by you, to them, inorder for them to give you some type of restitution. This would be a normal course of action, and may well be something you can take care of yourself.

Thank your advises. But I already try to ask few attorneys. They ask me more than $3000 in front, they will take cake this case. They will not warranty I can get recovery fund. Small claim has to have defender, but that guy had fled out US. I just find out that dealer is under different owner. And the checks I gave out was deposited into this owner bank account. That dealer had abanded. I don't know can I sue that dealer and that owner to get money back? But I don't know where is the owner living. Can corthouse locate him? Or How can I get his address? Please help me little more. I can't afford $3000 for attorney. Thanks

There has to be some sort of legal aid society in your area..From what I can see you will need some help...We cannot really give you legal advice since things are different in every state...If the dealership is a corporation which it probably is..the company name will be listed on you Secretary of States web site...This listing will include the name address of the officers and most important the name and address of the registered agent...This would be the address you would use.....All this is a little complicated I am sure there is an attorney in your area who will help and charge by the hour for advise...Have you tried your local Bar Association for a referral...Do not let this guy get away with this...

Contact the Attorney General's office in your state and tell him the circumstances.
