What exactly makes the mobile considered PERMANENT? Where can I find out what the law would require of permanent foundation. I am looking at one that is suppose to be on perm and would like to know what to look for and also I dont think that it is taxed that way. Thanks Christie

"permanent foundation" means different things to different folks...most often customers are concerned by the requirement that the home be "permanently affixed to the real estate" that many lenders might have..

.Most often this means nothing more than the home is set up to the manufacturers set up guidelines...passes local inspection...and has all running gear and hitch removed..and have some sort of underpinning...Most lenders will require the home be part of the real estate as far as legal documents are concerned...but this can easily be done at closing..In these cases the only interaction the lender will have is an appraiser who has to say it is permanently installed..

FHA and VA have much more defined definitions...this definition requires an inspection from a FHA inspector to verify the home meets the set up rules...these homes will have masonry skirting..the block or brick should be on footers..piers will be mortared or surewalled...home will be anchored..runnign gear and hitch removed...The only real problem is that different inspectors will have different definitions...One might improve it..one might not..

The manor in which the home is taxed currently has nothing to do with set up...It has to do with the taxing authorities rules in your area...most often having the home taxed as real estate is little more than asking for it to be done...In some states it is way cheaper to keep them separate for taxing purposes...but mortgage companies will require the property be taxed as real estate..

This sounds like a used home..if so you should get a professional home inspection by an inspector familiar with manufactured home..

All manufacturers of manufactured home provide an installation manual. The methods listed in these manuals are permanent foundations, from the footings to the piers and anchoring system. Under the HUD guidelines, they are permanent foundations. Anyone telling you anything different doesn't know to much about manufactured housing.

I have a question that perhaps you might be able to help with?

A few years a go I purchased land with a manufactured home on it. I purchased it from a bankruptcy auction, ( these sales are assumed that only that the land and all real property is sold with it )

What "legally" proves that a manufactured home is "real property" if was never recorded prior to my purchase.

We have had an appraiser look at it and in their opinion the home is on a foundation......who's opinion would create a "legal" determination.....

If the manufactured home was never titled or registered by anyone for the first 5 years of it's exsistance......was new and placed on a foundation on real property.....then the land was sold in a bankruptcy auction to myself. After my purchase of the land /? and home? as we thought. After the purchase, I extensive searching for a title or any trace of this home, never found any and then filed for lost title and got the home in my name.

Now the attorney for the wife of the bankruptcy is taking legal action, stating that I owe her for half of the manufactured home..........as she says that during the bankruptcy the proper releaf from stay was not followed in respect to this.

We are headed to mediation with our attorneys, yet I wanted some feedback if anyone else has advice or experience as to this dilema.

What does it take to finalize legally that the Manufacutured home is actually real property.....foundation, etc.......if it was never recorded anywhere at the time of installation or for years there after? ( Oregon )

Generally, if the title is retired, it is real property
