Because of the weather, my manufactured home being built at "OakPoint" in Middleboro will be delayed one month.
Unfortunately my house is being sold on August 14th and the date my place is suppose to be ready is Sept 15th. Needless to say this is going to cost me a lot of money to store my furniture and stay in a hotel or furnished apartment ( $3to4,000) What recourse do I have? The management at OakPoint says they have to go by what their construction company says and there is nothing they can do to speed it up. The bad weather has pushed everyone back one month (or more?)
Help???
House construction delay
Re: House construction delay
Is this really a manufactured home or actually a site built or modular home? Looks like it is one of the latter according to their site, and weather can be a big hinderance to either of those unlike a home actually being built in a factory setting. Not sure what kind of recourse you have. Just depends on what was specifically spelled out in your contract, and what actual closing date was agreed upon if any for the new house. You would think they would have to be responsible somewhat. That's taking for granted that there were no clauses in the contract that allowed or covered problems that may arise including bad weather which the contractor can't control. Check with an attorney, your real estate agent, or your bank. That latter two would make more sense for now as not to incur costly expenses. If it then warrants, you need to contact an attorney.
Re: House construction delay
Unless you were promised a totally unrealistic delivery date...one that could not have been met in any condition...I doubt that the dealer or contractor will have any liability...Weather is not contolable by him or any of his employees..
Wet weather has delayed jobs like yours all over the Eastern part of the country....I imagine from what I have seen some out West would not mind a day or two of delay now...
A good retailer might help out of the goodness of his heart...This kind of delay should not cost as much as you mentioned...There are furnished efficiencies available at about $190 per week in most parts of the country...Maybe your dealer will have some idea where..Good Luck...Hope there is not much more rain to slow things even more..

Re: House construction delay
Have you chaecked with the buyers of your current house to see if they will rent you this house after closing, worth a try. Most building contracts have a clause that they are not held liable due to labor or weather problems and some have a clause that says if any changes are made the date is void as well.
Re: House construction delay
There is a clause saying that the closing date depends on the weather. They pushed us back one whole month. I have to store my furniture plus find a furnished apartment. It has rained for 14 straight weekends up here in Greater Boston. Even the cheapest furnished
apartments go for $1400 a month. Unfortunately my kids do not live near me and eben then they don't have the room for 2 people.

Re: House construction delay
Make them upgrade the tires to "Z" rated, then have them drive really fast from the factory to your lot. That should knock off several days.
