park owner liablity for injuries

Chrissy,
My question is :
If some one is injured on one of our residents homesites resulting from a malfunction ( collapsing or falling over) of their shed,or a built on addition to their home can the Park Owner be liable or responsible in any way for damages or injuries?

Well, unfortunately, since lawsuits are typically for the financial gain of the party who is filing the suit, they usually look for deep pockets. In so doing, they will name everyone possible in the suit to better their chances of a large settlement. According to insurance companies, you are always liable for everything that happens on your property. However, you can take steps to limit the exposure you may have. Some ways to do that are to require that all outside buildings be approved by management for sturdiness, etc., prior to construction. You should also be doing regular inspections to make sure that there are no repairs needed. When you see something that needs repaired, you should notify the resident in writing so you have proof that you at least tried to correct the situation. Your commercial liability carrier may have more ideas.

ALWAYS CARRY LIABILITY INSURANCE ON YOUR RENTAL PROPERTY.
THEN LET THE INS. COMPANY FIGHT FOR YOU IN COURT. YOU WILL HAVE
TO BE FOUND NEGLEGIENT TO BE FOUND LIABLE BUT YOU CAN STILL
BE COVERED.
