Ok here's my situation

In Laws bought about 3 acres of land which they still owe on along with their mortgage of the land and manufactured home they live in but is deeded to them

which is the best way to obtain some of the land and place a manufactured home on it also for me and my family

(also to say the main road is at the top half of the property)

gift us a part of the land at the back (is basically a rectangle property line)

add me and spouse to the deed to the property

or sell us the back part out right

thank you for reading my dilemma and hope anyone can help or give info to acquire the help I need

You have lots of different issues here...

1)...local zoning and land use rules...most local laws have requirements about size of lots...access to the lots..frontage width..set back requirements..For information on this you will have to talk to the local officials in your county...They will even regulate the width of driveways and distance between them...

Subdividing the property will require a surveyor...a local surveyor will know the county rules and regulations..

2)...For you to put a home on this property..you will be looking for finance I assume...Your in laws own money on the land...they can give you a piece of property...but it will NOT be paid off...Having a deed does NOT mean it is free and clear...Before you could use this land in a land/home finance package..their loan would have to be paid off...or their mortgage holder would have to release their lien on the land...(not likely to do so unless they get paid off)...

Of course...you could finance your new home as a home only deal...but down payments and interest rates are much higher...credit qualifying is also much tougher..Home only finance usually will not finance wells..septics...land improvements like drive ways..these items would have to be paid out of your cash funds as well as your down payment.. If you finance as a home only you do not need to bother with a deed transfer...

You might be better off looking at a different tract of land and adding it to your home loan...
