sales tax on manufactured homes

I live in california and am purchasing a mfh from a dealer in arizona, he will be contracting out to get the home set on our land. He has charged us sales tax on the entire purchase including set up. I called the board of equilization over here and they said he should not charge sales tax as he is setting up the home for us and therefore it is considered a real property sale versus a tangible property sale. He is considered the consumer when he buys it from the manufacturer as he is the one contracting to have it installed (they said it doesn't matter if it is our property or theirs) They said that even if we were having installed on our own we would only pay sales tax on 40% of the sales price. Do you know anything about this???

Hello Debbie,

Usually the purchase price of a manufactured home has the set-up costs included in the over-all price. Example, a $60,000 double-wide would include options and set-up and delivery. In Washington State you would pay sales tax on the $60,000. This can range from 8.5% to 7.8% depending on which county the home was being set in. The laws in Washington state my be different from your state. I would contact your local escrow company they would know the answer to your question. Hope this helps.
