tree responsibility

Post by mickeyflorida » Wed Nov 16, 2011 12:42 pm

Hi,
I own a home in a gated mobile home community. When we purchased our home 20 year ago we were told all trees and plants planted were the parks property. The park planted a tree over the drainage system. The tree now is huge cracking my driveway and lifting the storm drain. I called ToHo and they will not enter a gated community. I went to the office and informed them the danger of the tree and its roots. It has already wrapped around our sprinkler system, cracked our driveway and as stated going into the drainage system. I was given a concern form to fill out. My question is Who should be responsible for the tree. The park did plant the tree right near the storm drain. I feel I will be fighting a losing battle on the responsibility. Thank for any help. A.W.

What is ToHo ?

Parks roads and common areas are not public property, Local authorities will not do any maintenance on the grounds.

Check your rental agreement or lease. The terms of the lease should state who is responsible for grounds keeping.
