My double wide mobile home is for sale. I have a buyer and all WAS going well. Until the lender tried to get the title for the mobile home from my mortgage company.They said they don't have it. Its loan has been sold about 4 or 5 times since I got it 15 years ago. Not me selling, but the mortgage companies would sale to aother mortgage company. My payment and all, always stayed the same, just paid to a different company each time.The land I paid cash for. Come to find out, the very first mortgage company still has a lien on it. But they are trying to get a title from the DMV. Why would they still have a lien when the mortgage company bought them out. And where would my title be ? I'm really afraid they will never get one. Its been 3 weeks and no word from the DMV.
PLEASE Give Advice if possible.

The lien was recorded with the original title and obviously the new lenders have never updated the state. I would assume they have the necessary paperwork to execute or enforce the lien of the original lender. How come you have not gotten a duplicate title your self. South Carolina has very helpful quick title offices. Your current lender will have the documents to release the lien when they are paid..

I'm new to all this legal stuff. Never knew I could get a duplicate.Thought it was like a vehicle and I would get title when it was paid for.Is 3 weeks an excessive time to already wait on one from DMV.What if anything can I do to speed it up. I don't have any paper work from where I bought the mobile home.It has always been in my name, but my ex took it with him,God only knows why,and that was 10 years ago.I have no contact with him.

The original title was issued and sent to the original lien holder so in theory when you paid the last payment they would sign the lien release and forward the title to the ownerS. As your paperwork moved from lender to lender the title should have followed along with documents to allow the new lender to release it to the person who paid it off.. Sounds like this has not happened. Three weeks for a mail in request for a replacement title is NOT unusual. 6 to 8 weeks is common.
In South Carolina you can go to the title office and they can tell you if they have received the request and what stage of the process it is in..SC has a VERY user friendly system. Title stuff is handled by the office where you get your car tag and drivers license. They should be able to help you get a copy. You will have to identify yourself and of course the lien will still be on it..Often you can walk in and walk out with a copy in hand. There will be a long line so be ready to be there for a few hours. I go to the one in Aiken County regularly and they are very organized but often the wait is over 1 hour. I am not sure you can get an official "original" but it would be useless without the lien release.
Most likely your X is on the title. if he is you AND him, he will HAVE to sign it to transfer it but if it is you OR him either of you can sell the home. Go by your tag and title office and see what they can do to help you. If there is a divorce, there is a process to get him off the title. Probably a good thing to do.

THANK YOU...I will go to the one you go to.I'm in Aiken also. I know for a FACT my ex is not on it, because I was not married to him when I purchased the home. Married afterwards and only for a few months.Long story, But anyway, at least MAYBE they can tell me something. I truly appreciate all your information !!
