How to change mobile home lien holder

My sister owns a mobile home in Las Vegas, and she owner-financed the home for $15,000. He is now the registered owner and she is the lien holder. He has paid her nothing to date except for $40.00 earnest money. He owes her $2,000.00 for the down payment, and 3 months of mortgage payments of $250.00 each for a total of $2,750.00. She calls and calls but he makes excuses for not paying. Now he doesn't answer any of her calls.
She is sick and tired and want nothing to do with it anymore. She is giving the mobile home to both me and my sister to register as the new lien holders. What steps do we need now to get the registered owner to pay up or get out? I sent him a 10 day notice by registered mail to pay the $2,750.00. How do we update the lien holders
My sister gave us a bill of sale but haven't had her certificate of ownership notarized saying that there is no room on the form.

Sounds like you and/or her should have had local legal advice when she financed this home. She can sell or give her legal interest in the home to you or anyone else she pleases...The new lender (you) will be bound to the terms of her original contract and be bound by the laws of your state that pertain to lenders and their rights to collect..If her original contract is not legally binding or faulty, you will not be able to collect. As far as the procedure to change the lien holders name and address only your states title office can advise you of the process they require. Once that is done you are the lender and lenders rights and responsibilities as far as collection and repossession are highly regulated by both the state and federal law..You might need legal advice to be sure you do not violate any of these rules. Debt collection violations can result in large fines and even federal prison time. Foreclosure process can often take long periods of time if the homeowner resists in court. Worse yet if he files bankruptcy you will be dealing with federal bankruptcy laws, all complicated and filled with potential problems. Legal advice is necessary to keep you from getting in trouble yourself..Since your sister had no legal advice ( NO ATTORNEY would have advised her to file the title without full down payment). Her contract might well not be to enforceable..GOOD LUCK

My sister has yet to produce a contract so I sincerely believe that there was only a verbal contract between the registered owner and her. She kept saying numerous times, "I trust him" and "I believe him." He and his girlfriend lived rent free with my siter for a couple of months where my sister even paid the utiltity bills. She told me that this guy needed to file the title to show that he was the registered owner in order to live in the MHP. The MHP does not allow renters.
Rmurray, thank you for your input. It was God sent and it helped us put things into proper prospective. My other sister will be going to the Clark County manufactured housing division to get instructions/information on how to file for the change oflienholders. After that, she will decide whether it would be in our best interest to pursue it further or just let it go.

The registered owner of my sister's mobile home is a Wiccan and I believe that he put a spell on my sister by giving her an amulet to wear around her neck. She has not been the same person that I know. She has gone to a couple of Wiccan meetings in Las Vegas. She lives in Hawaii now with her invalid spouse, but I believe she is still under his spell and is sabotaging all our efforts to fix her problems by delaying and not following through with her promises to us.

Maybe you need a priest instead of an attorney. Might be good to find an attorney who is a pastor of a church..
