I bought acrage and home, but never got titles to manufactured home, Seller said transfered with land, but in Georgia you must first make it real property.
There are still titles in the moter vehicle department, in the sellers and her ex-husbands name.
How do I get this resolved?
bought land and home--no titles to home
Re: bought land and home--no titles to home
Good question...Every state, GA included have a title retirement process..A while back homes sold and financed with land were not titled only transfer with language like yours...This was to satisfy mortgage companies making sure homes were not moved..Dealers would have drawers full of MSO's (the ownership papers before a title) Soon lenders figured out, no title was unsafe for them...The FHA (government) began to require all homes be titled and the title retired then included in the deed...All states started a process to accommodate these new rules..
You are VERY right to be concerned..In GA these folks could sell this home to somebody else or worse yet borrow money on it and not pay...I think the process will require the original owners (both of them) sign the transfer section of the title, then title it to you, then retire the title..All this assumes there is NO lien on the title to another lender...The title office can tell you if there is.
A discussion with your title office, clerk of the court and tax accessor might shed some light on the process...Better yet would be a real estate attorney fully familiar with the process..You can get names from local dealers (just ask one who they use to close their mortgages) It might be useful to use the closing attorney you used when you bought the property..the same one that did your land title search prior to your purchase.
