Selling Mobile Home

Post by ladyvalerie » Mon Mar 12, 2007 6:26 pm

My Brother, Sister and I have recently inherited our Mother's mobile home due to her passing two weeks ago. The home is in a mobile home park where she paid monthly space rent. We wish to sell it, and have been told by park management that the rent must still be paid until it is sold, plus $5.00 per day for storage. My sister has told the manager that we can't afford to pay the rent right now and that we expect to pay what is due when we do sell. We are concerned that management may be able to legally take the home from us for non-payment of rent. Any advice you can give me would be greatly appreciated

Thank you.

It is not so likely they could charge rent AND a storage fee...You did not mention which state the home is in...I am sure there is some agency that regulates parks and they should be able to help....They will be able to tell you the parks rights if the rent goes unpaid..It is not likely they could take the home any time soon....They probably can put a lien on it and will have to be paid prior to moving it...It is management like this that give the whole park business a black eye....

Thanks for responding to my post. The mobile home is in California. I forgot to mention that the $5.00/day storage fee will be charged as long as the rent remains unpaid. My sister has been living in the home for the last three years, however, she is only 50, and it is a 55+ park. Now that our Mother has passed away, the management says she can't live there anymore. I guess what I need to do is talk to the management and see what our options are.

Your state has great resources for helping you..

The CA MOBILEHOME OMBUDSMAN can be found here

http://www.hcd.ca.gov/codes/ol/ombpg-menu.html

You are right..you should talk to management then the state about your rights and park's power..
