Home Damaged by Condition of Land
Home Damaged by Condition of Land
I have lived in my home for 2 years, it is a double wide. It is an older home but in decent shape, but it is quite obvious that because of the condition of the lot (swampy, wet and erroding badly) and the fact that the trailer is not on any type of cement slab my trailer is being severly damaged probably beyond repair at this point. The floors are bowing awful and I am afraid that any day the whole thing is gonna sink into the ground. My trailer cannot even be put into level nor has it ever been abled to be level. I am wondering if anyone knows if there is any responsibility on the part of the landlord to compensate me for the damage to my home or if I have recourse against the landlord. Any help would be greatly appreciated! I am totally lost!
Re: Home Damaged by Condition of Land
I'm not a lawyer, but if you are renting in a park it seems to me that it is a reasonable expectation that you should be able to install a home with standard installation and have it solid and dry and if not then there is some responsibility of the landlord to mitigate drainage/ erosion issues and there should be some wording in your rental agreement as to the responsibilities of both parties. Read that agreement and see if you find something that you can show to the landlord that spells out their responsibilities and see if they will address it. Next step would be to contact the state regulatory agency responsible for manufactured home installations and inspections and see what they have to offer in the way of help/ advice/ mediation/ intervention in your situation. Lastly would be to go to a lawyer if it truly is the landlord's responsibility. Good luck!
