Should a certificate of occupancy be issued by the county on mobile- manufactured homes?HUD certifies these homes and may not use the applicable codes for the county.Normally only periphery items are checked by the county inspector,skirting,tie downs,electrical service etc.These inspections constitute a certificate of completion, not a certificate of occupancy.Modern manufactured homes are built quite well,but who should bear the responsibility of issuing a c.o.,required in most counties?Some older manufactured homes are not code worthy and we"re told as long as HUD has issued a certificate a c.o.must be issued.

The HUD Code, is a federal preemptive code. Each state has legislation that adopts the federal code, and provides for the necessary statues on installation, anchoring, and the like. Certain other responsibilities fall to the State Administrative Agency, which has the duties to enforce and monitor the code within the state. This will also be the statue that designates the responsibilites of the building and or code officials within the state.

Actually most states have specific rules about used homes..Some even offer inspections for health and safety issues...I would suggest you check with your states agency dealing with manufactured homes..

In fact, the HUD code only applies to NEW homes, first purchaser, for used homes, the HUD Code preemption deal is over.
