unpaid taxes

Our MH was purchased a year and a half ago as a repo already on land. It's a wonderful home and we love it. We had no problems until last year when property tax bills came out. That is when we found out that the previous owners had not paid the taxes on the home for 2 years. I contacted everyone involved with the exception of the previous owner which I have no way to contact. Conseco is my finance company and we have had some problems with them in the past over other things. The woman I spoke with last year on this matter talked with her "higher-ups" and told me to fax an itemized bill to them and they would pay the taxes that were past due up until the time we took posession of the home. Well, tax bills came out this year and guess what. They did not pay the late taxes! I contacted them again and got a huge run-around. The woman I spoke with, at one point, stated that there is no way the they could have sold me the home if the taxes had not been paid on the home since that is necessary in order for the title to be transferred. She told me that I would have to get the itemized bill again and fax her a copy and she and others would have to do some investigating into the situation. Then they will see what can be done. Not only this but only 3 or 4 months into the loan they decided that they would change the due date of our payments. They did this without any notification to us except for the bill with the due date on it. This made the payments 20 days earlier than is stated on the contracts. When I contacted them on this the only solution they had was for me to send the payment on the original due date (which would make it only 20 days late!) and not worry about the payment date on the bill. I can't figure out why they didn't just change the due date back. Anyway, the question is, do any of you think I should take this to a lawyer? I am so fed up with dealing with them and nothing being done. Also, if they "couldn't have sold me the home without the taxes being paid" but the contracts are signed do we own the home? Any suggestions would be helpful.

Conseco (now Greentree) itself has gone through lots of change during this period of time...Conseco filed bankruptcy and the manufactured home finance company was sold at auction to the new owners...

The person who mentioned that they could not transfer title with out taxes paid is wrong..They might be right in some states..but all states have different rules and this person probably is not aware of yours...

You should be able to check the title documents with the state agency responsible in your state..these records are public...

They CANNOT change your payment date...your contract rules...be sure to check you credit rating and be sure they are not rating your account slow...also be sure they are not adding late charges every month....

As far as an attorney is concerned...for back taxes..it would not be worth the cost..plus the new lender probably would not be legally responsible...just hope they research the problem and decide to help you out of a sense of obligation..

The payment date is a different story..the new lender must honor the contract...If they are adding late charges..or...bad mouthing your credit..you may need help...of course...you could send an extra payment (maybe at tax refund time...it will be larger this year because of the tax cut) and then you will always be 10 days early...far cheaper solution than an attorney..
