Fencing/carport issues

Hoping you can help...

Yesterday our new neighbors installed a vinyl fence on their property between our carport and their front door. The problem is that we have one of the smaller units in our complex and do not have a planter or space between the properties like most units in the complex do. Because of this we use the walkway between the two properties to take out the trash cans, getting into our cars or just getting around them without having to go up and down the entryway/stairs. Now because of where the fence was placed we can not even get into our cars without hitting the fence and will have to pull out both vehicles just to put our trash out. The property manager came over and measured the space and said they are on their property line and can do whatever they want.

Now, when the previous homeowner of our unit requested to install a vinyl fence all the way down the property line he was denied (thank goodness) because of some regulation and the carport clearance. Also, he was denied the use of a solid fence and was told it had to have openings to see through. So my question is this what are the regulations on installing a fence and must there be some sort of clearance on the carports so the owners in the adjacent home can access their vehicle or get a trash can in-between the fence and the carport beam? Also, they have installed the fence so going across their front entryway/stairs; is there any regulation of that? Is there a standard clearance that must be from a carport beam to another structure or fence? How can I tell where my property line is and the neighbors line begins? Right now the only thing I think I may be able to get him on is that he installed the fence at a slight angle and the back end may be on my side; however, I am hoping can you provide me with more information that I can get this removed or moved back.

**He installed 2- 8’ vinyl fencing panels starting 8 feet from the back brick wall which is where the one 8 foot panel on my property sits (This was installed by the pervious property of my unit) which was the only one he was allowed to install). However, there is a nice wonderful space of approximately 14” between the 2 fence posts and a little bit more on the first 8 foot panel which is the one causing all the issues.

If I can’t get him on anything maybe I can get him on the fact the is on our property line on the back side and I either agree to let it stay if he removes the first panel and extends it to the back…

Any help or guidance you can provide is greatly appreciated!

You make it sound like you own as opposed to rent the property. You did mention a manager which leads me to think you might rent the lot. If you rent the lot there is little government will do for you. You should read the terms of your lease and insist the management enforce them if they help you..such as the portion on your leased property. If you own the lot you can have a survey done and contact your local building department for set back requirements and ask for help in enforcement. There will be no rule how far from your carport but maybe from the property line.
