right to cure
right to cure
I need some information on right to cure letters. I originally had a loan with GreenPoint, which has been turned over to Greentree. I received a right to cure letter on January 31, 2005 because I had gotten behind. In February I paid the amount needed and brought my account current. I incurred some financial troubles beyond my control in the last couple of months and have fallen behind again. I owe for April, May, and June. The Greentree collections rep tried to get an extension and couldn't for all three months. He did say on June 27th that if I made one payment that day they would possibly be able to do an extension for the other two months. Otherwise, they would foreclose and have my family and I evicted on June 27th. He says the right to cure letter went out on January 31st and the account has never been brought current (which I know it was in February), so they have a right to evict. Do right to cure letters expire if the account is brought current or do they have an expiration date? Does a new one need issued or can they evict without any notice? Today, June 28th, I told the rep I could have a payment Friday, July 1st. He said he needs it today or they will evict tomorrow. His story keeps changing, so I'm wondering if these are scare tactics or do they have a right to evict tomorrow?
Re: right to cure
wow. I have exactly the same problem. 3 month behind, cure letter, everything. The wont take partial payments on the cure letter. They need it all. The wife has been told to pack up and move.
I send them what I have. If they cant take it send it back and come get your trailer. That's what I tell them. Cure letter or not. even after cure letter, they still have to start lawyer actions. They don't want the house or to take legal action. Don't let them scare you. Send what you have.
