unsecured loan, unclean title

Post by Saundra » Thu Oct 21, 2004 12:48 pm

I purchased a reposed manufactured home from a dealer in Victoria, Texas. We "closed" 8/24/04. The home has not been moved to my property. Wells Fargo has paid the dealer, I have begun making payments on my unsecured loan and the bank does not have a title. There is still a 10,000. tax lien on the home the dealer has yet to pay. At first Wells Fargo was very conserned about their involvement but when the banker talked to the dealer , the banker then told me what was occuring was common in these transactions and I had to pay my mortage. I have contacted a lawyer but I can not seem to find one who knows the law about this situation. Help. Is this legal???? Saundra

It is not common for a bank to pay money to a dealer without the title...

It is not common to be paid for a home and not deliver it for over 55 days,,

$10,000 tax liens are VERY uncommon on manufactured homes..

NOTHING HERE IS COMMON..

There has to be attorneys familier with contract law in your area..

You are lucky to be in TEXAS...They have a well organized and accessable oversite agency dealing with dealers and dealer licenses...Although they do warn about buying from unlicensed dealers...Go here for info on this house...and info on this dealer..and the compliant and consumer help section...

Good luck..Do not delay...
