I purchased a Hart manufactured home from a dealership in Indiana. They were in the process of having my home set up the first part of the home was on the foundation when heavy rains hit, it was the Labor Day weekend so noone was working. The Tuesday following Labor Day the setup crew came back and finished setting my house and putting it together knowing that there was major water damage inside. Right now I am having problems getting someone to take responsiblility over the damage to my home. I have not taken possession of the home and I haven't signed any papers. Do you know if I have the right to make the dealership come take the house back and have another one delivered?

By all means don't close on it.You have a legal right to get what you bought and incompenent set up is not part of the deal.If they left the sections open to the rain I would not want the thing.If the damage is cosmetic and repairable perhaps you might be satisfied with repair.If you havent closed they will try to make things right,If you have closed and have a shady dealer you're screwed.Your story is one I have heard many times before.You just can't live these things open to the rain,the materials many MF homes are made of don't do well in water.

Thanks for replying, I have closed on the construction loan part of the loan but not the actual loan. I haven't signed papers from the dealership to take possession of the home. Right now the dealership is talking about taking the damaged home out and putting a new one in. I just hope they follow through. I just wasn't sure since I haven't signed any papers from the dealership to take possession of the home if I had to accept this one and let them fix it or if I could demand them to bring me a new one.

Be careful...you should be communicating with the attorney or mortgage company that holds the escrow funds of the consrtuction loan...often draws are given without any consumer acceptance...
