Selling to a Dealer

Post by Rich » Wed May 24, 2006 10:12 am

Is it normal, or safe legally, to sign documents without a date when selling to a dealer? The dealer claims that they will add the date when they take it to escrow. We will be paid the balance at the close of escrow. Since we are not paying escrow fees they claim that we dod not need to be involved with escrow. This leaves us without signed and dated documents and we are not comfortable with that. Is this really how it is done?We can not find any printed laws on this..

It is not good practice when your buying or selling, to sign any documents that are not complete. Blank spaces or a lack of a date means that any thing can be inserted in these areas. Insist on complete documentation or just dont sign.

Selling to a dealer makes for a fast and easy sale. Talk to other dealers in your area to see if they might be interested in your home. If your selling the home with the land talk to one or more real-estate agent in your area. They may be able to find you a buyer that will offer a better price. Additionally take a look at the FOR SALE BY OWNER possibilities in your local newspaper or here at the FSBO ONLINE section of this web site
