ESTATE MODE M/H TRANSACTIONS THE STATE STATUTES ADDRESS THE NEED FOR A SURRENERED TITLE TO THE M/H IN ORDER TO CHANGE THE PERSONAL PROPERTY CLASSIFICATION OF THE M/H STRUCTURE TO THE
"REAL ESTATE DEFINITION. IN ORDER TO DO THAT THE M/H MUST BE
INSTALLED AS A PERMANENTLY AFFIXED STRUCTURE USING A FOUNDATION SYSTEM WHICH THE STATE "SUPPOSEDLY" HAS A DEFINITION. WHEELS,AXLES,RUNNING GEAR BEING REMOVED AND
CONNENTIONS TO APPLICABLE UTILITIES ARE PART OF,BUT NOT THE
TOTAL "PERMANENT ATTACHMENT" THEORY AS WE UNDERSTAND.

Also try reviewing the new HB1869 which took effect 1-1-2002. I believe it can simplify your situation. As i understand the bill, MH's purchased/sold after 1-1 (wether on leased or on private land) are considered "real" property for purposes of title and taxing. I do not know about MH's owned prior to 1-1-2002. I myself relocated my home to private land just before 1-1 (TXDOT isn't issuing permits...long story) & when i contacted the Appraisal District to update for taxes i was notified that i can "tie" the home with the land...efectually making the home/land combination one "real" property entity. However, i have a choice in not doing that...since my home was placed prior to the bill taking effect. I'm not sure how this effects MH's still in leased space (i.e. in a park). Anyway...i do know that MH's purchased/sold after 1-1-2002 must have a closing in a licensed title company....just like site-built homes. All titles prior to 1-1-2002 are considered personal property, therefore I would think transfer of title into a "real property" could be as simple as converting through a re-closing in a title company setting and therefore legitimizing the title to "real property". Am I wrong?
