Has a precidence been set in NC?

Post by Anton » Sun Apr 11, 2004 9:10 am

My problem is I want to place a doublewide manufactured home, built in year 2000, on a lot that has restructions to "trailers". This subdivision restriction was placed on the deeds in 1968. In my research on this have been told: a trailer is a mobile home/manufactured home or whatever the name has been changed to. Trying to find a precidence that has been set in the state of NC concerning this. Any info will be appreciated.

Good Luck...You need a local attorney who specializes in real estate law in NC..

If there is no precidence...maybe you might want to go to court to get one..

Anton:
While the laws in NC that govern such matters are likely to be different than those we usually confront, our work in the New York/New England area suggests any effort to overturn a deed restriction will not be easy. Fortunately for us, we've never had to directly undertake that type of legal battle though we've heard deed restrictions may be lifted only in cases where the restriction is illegal or unreasonable to the extreme.
In any case Murray is right: If you intend to pursue the matter get a good real estate attorney. A barrel full of greenbacks will likely be helpful, too.
Good luck.
