I have the joyous task of trying to sell my deceased father's used mobile home. The MH still has an outstanding balance on the loan. My name is not listed on the loan, nor on the lot rental papers. I was told by a lawyer that I do not have any legal obligation to sell it or to pay the lot rent. Unfortuneately my dad did not leave any estate to pay the MH off. Does anyone know what happen in this situation? I listed the MH with a realtor for three months. The contract is ending this May 31st. I also have put a For Sale sign in window and had a couple of calls but no one wants to pay anywhere near asking price (I am asking only for outstanding loan amount). Thanks.

This is a question much better suited for your attorney...Sounds like he is recommending you give it back to the bank...the only real question is how it might effect the rest of the estate...if any..
Beyond financial concerns..there are emotional concerns for you...One way to look at it is that surrender to the bank..is no different than selling it to them for the payoff...They are big boys and deal with this type of stuff everyday...The loses are planned for and they can better afford them than you....Personally...I think it is better to finish the probate...and get your photo albums out and remember the good times...get the unpleasent stuff over and go on...
Listen to your attorney...take care of yourself...Good Luck

Who is the home financed through? If it's the now out of biz Conseco, they offer a TOE program(Transfer of Equity), which is very easy to sell to people with credit issues. They basically take over the loan and can get in with very little down. just an idea....
