I am not sure where to even start. I just bought land and a 2002 Fortune Home.
We started this "LONG" process in April,after hearing that we were approved (well she told us "tell your landlord you are moving,which we did) for our loan we were told to come in and fill out the papers,only to get the run around and then find out that the woman working for this dealer had since left,been fired and took all of our files with her. This file contained all our information needed to apply for a home loan. This left us starting from scratch,mind you I should of thought better of it.
After weeks of filling out papers and phone calls between the dealer and my husband and self we finally set down to order our home. We carefully looked over what we wanted in our home and what upgrades we wanted. We told the dealer we wanted it like the model on the lot (which has since been sold) only we wanted to change the pitch,carpet and we wanted drywall.
Our house was supposed to have been ordered in June but I since have found out is was a month later. I found this out cause there was some "standard" things missing and no one wants to fix them,such as the master bath was to come with two sinks. The factory stopped doing that as of July 10,therefore my house wasn't ordered then. Although I "thought" it had been,and was told it had,on papers I have it is dated as having been ordered in June. Papers from the dealer mind you.
When the house "finally" got here it sat for a week before someone set it,2 setting crews were fired for not showing up (which was the case for most of the construction that needed to be done,no one came when they said) again "finally" someone came to set it and as they were sitting it they were talking about how they never set a house this big (it's 2300 sq feet). Which showed in how it was done.It took them 2 1/2 weeks to set it,finsih the siding and the roof.
I guess I should of said that during this whole process,I did what I thought to be good research on manufactured homes,so as not to go into it blind,I also wrote all dates I talked with people from the construction crew,dealer and took photos of the home being brought in along with a video of my walk through.
Ok the walk through,well I knew the inside had to have problems,cracks and doors needing rehung because I could see many problems with the roof such as nails and staples sticking up,and a skylite that I didn't order.
What I did order is syklites in 2 of the three baths (like the model) and after the order was supposed to have been sent in I called to check the progress on my home and was informed that the skylites couldn't be put in cause the pitch of my roof,although the skylite that was added was added on the same side,there was a small window added to the other bath. I had asked if they could place a window in this bath if they weren't putting in the skylight,when the house got here I had a 1'x3' window. Some windows don't open anymore than 2 inches and then you can't get them shut. There is many cracks in the walls and ceiling and all this was pointed out when I did my walk through.
Along with other missing items,such as toilet paper holder ( 2 baths had them ) light fixtures,the double sink in the master bath,and the upgrade on my sinks ( they installed plastic).
This is just the "TIP" of problems and I am not sure how much of it is dealer and how much is factory. One of the bedrooms was ordered as a den (dealler idea) to save money on the septic (mind you he is now trying to get me to pay more for the septic cause there was problems),to which there is no closet, I have been since August trying to get this closet put in and having no luck,seems there is always a reason the contractor don't come.
Another thing,I did call Fortune homes and seem to be getting the run-a-round there as well,they said they can't tell me what the price is on things that are missing,nor can they tell me how much my home cost. ( I get the feeling now that the dealer is trying to pocket more of my money,since in our contract it has the price of the home (72,000)and the construction (which is broke down) 26,000
When we sat down with the dealer to discuss the money end we were never shown any reciepts,only seen him write numbers and then say " well I won't charge you for that" , I don't believe that he is doing me any favors by this and it makes me all the more worried on the "real" prices.
Our walk through date was moved twice without reason which moved our closing.
After seeing what took place on the dates of our walk through I now know why it was moved. Our driveway didn't meet our loan requirements (there was a major sink hole at the turn around) there was to be steps off our sliding glass doors,termite inspection and the steps at the other 2 doors weren't big enough. This is why I feel it was moved twice.
Last week I have the health department at my door to test my water and to inform me that it was to be tested "before" we moved in,which I has assumed was done. Since I was told by the dealer the hold up in construction was the Health Department. Anyway he took his sample and told me they would call if there was a problem,and low and behold my phone rang.There is a bacteria in my water and they will not tell me what it is ,mind you my family has been using this water for almost a month now. Thank God no one is sick. I was told I needed to pour bleach down it but he couldn't tell me how to do this since my well is an artesian.
So this is where my questions begin,
1.)Do I have to pay more for the construction work,i.e. I was told the septic would be 3,600 and now they are charging me 1,300 more.
2.) How long does the factory,dealor have to fix these problems (closet,venting isn't hooked up at one end of the home)?
3.) Is the dealer/well digger responsible for the charge on the Health department coming back to take another sample? Shouldn't they have had this tested before I moved in?
4.) How do I find a break down on how much I was charged? I don't want to pay for the things I didn't order such as the skylight ( which was not where I asked for it to be the dealer took it upon himseld to put it there whithout asking) and how do I find that I am not paying for things I didn't get,such as the 2 skylights and sinks?
Can anyone answer these questions for me,or tell me how to find out short of getting a lawyer?

Your big stick is closing..I sounds like you have already done this...
Almost everything you have mentioned sounds like a dealer problem..many of the specific problems are directly related to set up..
Have you calmly sat down to talk to the dealer about all of your trouble..
WELL...This is very common on new wells.....there is a treatment that needs to be done for the long term safety of your family...If you do not know how to treat the well call the well driller...he will be able to advise you of the proper proceedure...Every well is different...Wells should be tested every few years...maybe more often if your well depends on ground water...These retest fees are not the resposibility of the well driller unless you have a writen guarantee of potable water..Seldom are these included..
How would the dealer collect extra money on the septic at this time.??.after the close..If his contract clearly says $ 3600...he would never be able to collect in the court..Of course you will have just about as much luck in court collecting your extra closet..This kind of skirting the law probably will not be enforced..You agreed to this room and if the closet is not separately in the contract...I would give up..
As far a break down of charges is concerned..I cannot imagine how you even began to accept a home with so many problems in the order..If the items are detailed in the order...you should get a refund...truth be told you are worried about only a very few dollars here..There seems to be MUCH more important problems..
You have not mentioned which state you are in...but you should file a complaint with the state agency that handles complaints in yours...especially about the set up problems...They will have nothing to do with the contract problems..for this you may want to consult with an attorney...
