Still Stuck, Park Manager Interference (Continued)

Hi Folks,

I am currently experiencing interference from a Park Manager in the sale of a MH. I have had 2 contracts for sale interferred with and am at my wits end. I feel that if I had Mother Teresa for a Buyer she would be denied. I am helping a friend but I cannot pay Lot Fees on an empty MH any longer (4 Months already). I stopped paying lot rent to cut my losses, if they allow me to sell I will pay it then, otherwise I can't see losing any more money on this one, Ouch!

Manufactured Homes Communities, beware of them!, as this is the Sam Zell Corporation that runs the Park. They have about 5 Corporations, Orangeland Vistas, "Carefree Sales" (for them), Realty Systems, Manufactured Homes Communities, Etc.

Can anyone recommend a Mobile home attorney in Pinellas County that will represent Private Owners, as I feel frustrated and this is Wrong and I believe Violates FS 723.059

Ps They seem bent on stopping any sale and want to foreclose to 'steal' my personal property after preventing me from selling.

Did you find out how to contact your state association??? I do believe that Florida has one. As stated before, Manufactured Housing is not a liscensed regulated industry(Other than standard business liscense). Most developers seem to have the upper hand in winning most legal battles. You need to deterimine how far you want to take this. Again, your state association and your local politician would be economical ways to start rather than to hire an attorney and going head to head with the developer with you racking up legal fees in addition to lot rent.

Hi,

No, I know that Department of Business and Professional Regulation (DBPR) Has a complaint form but I do not know what association you are referring to. I believe there is one, however, I am not Privy to it.

If anyone knows the contact information for this, it would be appreciated by all MH owners in Florida and would contribute to a little parity for PEOPLE who own MH's.

That site appears to be a New MH manufacturers organization. I believe the site may be FMO.org, I am not sure if this is the correct place to channel my complaints or not. Thanks, Walt

Any retailer, community owner, etc.(especially a large corporation that owns your park) will be a member of the state association. It is governed by an elected board of directors from all facets of the industry. They should be willing to listen to any complaint that they feel that would compromise the integrity of the industry. I have another problem, if you live in a mauf home park that the land remains with the devoloper, be very carefull that like me if it is a 55 and over park how it is advertised or permoted. If like me, the owner does not stay within the requirerments of the law, you and other home owners have no way of protecting your investment from the park owners selling to anyone who wishes to buy regardless of age. This is just what our park owner is now about. Most of the current owners are from the late 50s to some in there 90s and invested in a home in this park in order to be involved with those of their age group with like values and interests. When I moved into the park the then owner looked upon the park as an investment to protect, grow in value. When he passed on the wife turned over the mamgement of the park to her daughter and her husband, they have a much different view of the park they view it as a cash cow, that funds other investments. They now only repair those things that must be repaired to keep the park going. They fail to cut the public area lawns, repave the roads, care for the Rec. building, swining pool maintaince, and in general provide what any reasonable person could expect from mangement of a park they invested in. These new mangers do not uphold the 55 and older requirerments when a resale takes place, which is their sole right to accept or reject the sale. The result is more and more of resales are being made to anyone who has an accepitable offer to the owner of the home, with little regard to the remaining owners. There are no laws here in Florida that protect my contract with them to maintain the park as a 55 and over park. You can of course go to court and sue the park owner for breach of contract if you wish to invest thousands of dollars and fight not only the park owners, but their assocication, and they will appeal any judgement in your favor as long as it takes to win. You can not sell because of lack of buyers and disaproval by the mangement of the offers you have had, but there are two sides to that coin. Everone should be outraged that the goverment does not think twice about protecting the park owners rights, and could care less for the every day citizens rights. Both of us trusted in the good faith of a park owner and the laws of land, and both have found that was a pie in the sky trip down the road of life.
